WAIVER & RELEASE
By participating in any activities, events or classes either
online or in person by Rebel Origin YOU AGREE AND CONSENT TO
BE BOUND BY ALL TERMS PRESENTED IN THIS WAIVER AND RELEASE.
Livbe LTD (DBA Rebel Origin) requires that all participants
follow safety rules and instructions that are designed to
protect everyone’s safety. However, you acknowledge that there
is an inherent risk of injury when choosing to participate in
fitness activities. YOUR RESPONSIBILITY You are solely
responsible for determining whether you are physically and
mentally fit and/or adequately skilled to participate in Rebel
Origin activities and/or classes. Risks from participating may
be aggravated if you are pregnant, suffer from an underlying
medical condition, take medication, smoke cigarettes, have a
family history of coronary disease, or have recently suffered
an illness, injury or impairment. Accordingly, it is your
responsibility to consult a physician before undertaking any
fitness activity. It is also your responsibility to determine,
during your participation in any Rebel Origin activities
and/or classes, whether you should discontinue your
participation in such activities or take any other actions to
protect your health or safety. RIGHT TO USE In addition,
because Rebel Origin captures its indoor exercise classes on
video, audio and still images for broadcast to members across
the internet, by participating in virtual exercise class you
grant Rebel Origin permission to use some or all of your name,
visual likeness, voice recording, graphics, photographs or
other artwork and any other information you provide to Rebel
Origin or its employees or agents (such as instructors) (for
simplicity, these items will be referred to as “Materials”) in
one or more of its content, products and advertising, in any
form or format now known or hereafter created, and distributed
or made available throughout the world in perpetuity, without
compensation to or further approval from you. If you do not
want the Materials to be captured, published or broadcast for
such uses, then you must inform julie@rebelorigin.co or choose
not to participate in any virtual exercise class in any studio
or location. You understand and agree that Rebel Origin shall
be the exclusive owner of its products, content and
advertising, including those containing the Materials, and
that you are not entitled to any remuneration for such use.
WARNING OF RISK FROM FITNESS ACTIVITIES
Aerobic and other fitness activities such as indoor cycling,
running, or jogging, plyometrics, yoga, floor and barre
exercises, passive/resistive weight training, use of stair
machines, treadmills, rowing machines, free weights, and other
training devices are intended to challenge and engage the
physical, mental and emotional resources of the participant.
Despite careful and proper preparation, instruction, medical
advice, and conditioning, participation in fitness activities
involves a risk of serious injury. All hazards and dangers
cannot be foreseen. Depending on the particular activity,
certain risks, dangers and injuries due to overexertion, lack
of hydration, improper technique, ignoring safety precautions,
failing to properly follow instructions, slips and falls,
unfamiliarity with the equipment and/or exercise, equipment
failure, failure in supervision/instruction, premises defects
and other risks inherent to the particular activity exist.
Nonetheless, you hereby agree to assume all risks of your
participation in Rebel Origin activities and/or classes,
whether known or unknown to you. Depending upon a person’s
physical condition, age and/or skill level, fitness activities
can involve a substantial risk of the following types of
injuries, among others: (i) heart attack, stroke and
circulatory problems, (ii) bone and joint injuries, (iii) back
and neck injuries, (iv) shin splints, (v) muscle strain and
other muscle injuries, (vi) foot problems, (vii) psychological
injury, pain or suffering, (viii) disfigurement, (ix)
temporary or permanent disability (including paralysis), (x)
death or (xi) economic loss. In addition, a very small
percentage of people may experience a seizure when exposed to
certain visual images, including flashing lights or patterns
that may appear. Seizures may have a variety of symptoms,
including lightheadedness, altered vision, eye or face
twitching, jerking or shaking of arms or legs, disorientation,
confusion, or momentary loss of awareness. Seizures may also
cause loss of consciousness or convulsions that can lead to
injury from falling down or striking nearby objects. If you
experience any of these symptoms, you should immediately stop
exercising and consult a doctor.
MEDICAL EXAMINATION
It is the responsibility of all participants to have a
complete physical examination by a medical doctor prior to
beginning any activity. If a participant has, or has a history
of, any of the conditions listed in the “YOUR RESPONSIBILITY”
section of this document, he/she should consult a physician
before participating in any fitness activity. WAIVER AND
GENERAL RELEASE OF ALL CLAIMS AND ASSUMPTION OF RISK
You recognize and acknowledge that there are inherent risks of
physical injury to participants in any fitness activities,
including when participating in any Rebel Origin events, and
you voluntarily agree to assume the full risk of any and all
injuries, damages or loss, regardless of severity, that you
may sustain as a result of said participation. As a material
inducement for Rebel Origin to permit you to participate in
Rebel Origin activities and/or classes, to use Rebel Origin
facilities or Rebel Origin Equipment, you hereby, on behalf of
yourself, your heirs, executors and assigns, fully, forever
and irrevocably waive, release and hold Rebel Origin, its
shareholders, directors, agents, representatives, employees,
consultants, affiliated companies, partners, and successors
(collectively “Rebel Origin Parties”) harmless from any and
all claims (including, to the extent permitted by applicable
law, claims alleging negligence on behalf of any Rebel Origin
Party), injuries, damages or loss (including legal fees),
present or future, foreseen or unforeseen, anticipated or
unanticipated (collectively “Claims”), that you may have (or
that accrue to you) against any Rebel Origin Party, and
generally release and discharge the Rebel Origin Parties from
any and all Claims, including but not limited to those
involving: (i) participating in any supervised or unsupervised
fitness activities, (ii) use of any fitness equipment,
including Rebel Origin Equipment, (iii) any loss or theft of
personal property, and (iv) accidental injuries, such as “slip
and fall” injuries on or outside of Rebel Origin premises, and
you hereby promise never to assert or assist any other party
in asserting, any claims or causes of action against any Rebel
Origin Party in any matter that in any way relates to any
Claims. FOR Rebel Origin EMPLOYEES:
VOLUNTARY PARTICIPATION
If you are a Rebel Origin employee, you acknowledge and agree
that your participation in Rebel Origin activities and/or
classes and your use of Rebel Origin Equipment is purely
recreational, voluntary and of your own free will, and is not
a condition or within the scope of your employment with Rebel
Origin (unless you are the Instructor designated by Rebel
Origin to lead the fitness activity in question). To the
fullest extent permitted by law, in addition to the release in
the preceding paragraph, you agree to fully release and
discharge the Rebel Origin Parties from all liability under
any workers’ compensation insurance plan and relinquish any
right to sue the Rebel Origin Parties in connection with any
injuries, damages or loss, regardless of severity, that you
may sustain as a result of said participation. By
participating in any fitness activities and/or visiting Rebel
Origin premises you agree and acknowledge that you have read
and fully understand the above important information, warning
of risk, authorization, assumption of risk, and waiver and
general release of all claims.
AUTHORIZATION:
In the event of any emergency, you authorize Rebel Origin to
secure from any accredited hospital and/or physician any
treatment deemed necessary for your immediate care and agree
that you will be solely and personally responsible for payment
for any and all medical services rendered and for the cost of
travel to and from the place of medical treatment. I represent
that: (i) I am at least 18 years old; and (ii) I have no
health-related conditions that could affect my participation
in Rebel Origin activities and/or classes. I have read and
fully understand the above important information, warning of
risk, authorization, assumption of risk, and waiver and
general release and discharge of all claims.
Terms of service
Please read these Terms of Service (“Agreement”, “Terms of
Service”) carefully before using www.rebelorigin.co (“the
Site”) operated by Livbe LTD (DBA Rebel Origin) (“us”, “we”,
or “our”). This Agreement sets forth the legally binding terms
and conditions for your use of the Site at www.rebelorigin.co
By accessing or using the Site in any manner, including, but
not limited to, visiting or browsing the Site or contributing
content or other materials to the Site, you agree to be bound
by these Terms of Service. Capitalized terms are defined in
this Agreement. These Terms of Service set forth the legally
binding terms for your use of Rebel Origin Services. You are
only authorized to use the Rebel Origin Services (regardless
of whether your access or use is intended) if you agree to
abide by all applicable laws and to these Terms of Service.
Please read these Terms of Service carefully and save it. If
you do not agree with it, you should leave the Rebel Origin
website and discontinue use of Rebel Origin Services
immediately. If you wish to become a Member, you must read
these Terms of Service and indicate your acceptance during the
registration process.
ACCOUNTS
In order to access some features of the website, you will have
to create a Rebel Origin account. You may never use another
person’s account without permission. When creating your
account, you must provide accurate and complete information.
You are solely responsible for the activity that occurs on
your account, and you must keep your account password secure.
You must notify us immediately of any breach of security or
unauthorized use of your account.
MEMBER SERVICES AND POLICIES
CANCELLATIONS: YOU MUST CANCEL CLASS 24 HOURS IN ADVANCE OR
YOU WILL BE DEDUCTED THAT CLASS. This includes switching time
slots under the 24hour notice time period. You may cancel
class through our online system or by calling the applicable
studio directly.
RESERVATIONS: You must use the site Rebel Origin.co to book
classes.
MEMBERSHIP PACKAGES:
Members who purchase ANY membership package are subjected to a
penalty charge (fee amount varies between individual studio
locations) for either a late cancel or an absence should they
not cancel their reservation within the allotted 24-hour
window.
PERSONAL BELONGINGS:
You agree that Rebel Origin is in no way responsible for the
safekeeping of your personal belongings while you are present
in the studio. You assume all risk of loss for any of your
personal belongings.
CLASSES RULES AND REGULATIONS
For in person classes: You must be physically present and
checked in 5 minutes prior to the start of class or your spot
may be released to a waitlisted client. No exceptions.
For virtual classes: You must log in 5 minutes prior to the
start for any virtual classes or your spot may be released to
a waitlisted client. No exceptions.
Reserved classes must be changed or canceled within 24 hours
of scheduled time or they will be forfeited.
Membership packages are subject to a penalty fee for a late
cancel or absence.
If recovering from injury or illness, notify the instructor
prior to class start time.
REFUND POLICY
Classes:All classes and membership packages are
non-refundable. No exceptions.

LIMITATION OF LIABILITY
By signing up and/or attending in person or virtual classes,
events, activities, and other programs and using the Rebel
Origin studio facilities and equipment, you hereby acknowledge
on behalf of yourself, your heirs, personal representatives
and/or assigns, that there are certain inherent risks and
dangers in the strenuous nature of the Rebel Origin workout
program, you hereby acknowledge that you have voluntarily
chosen to participate in an intense physical exercise program.
You understand that Rebel Origin strongly recommends that you
consult with a physician prior to commencing any classes. By
signing this document, or by signing up or booking a private
class or by joining a class, you acknowledge that you have
been fully informed of the strenuous nature of this exercise
program and the possibility of adverse physiological
occurrences including, but not limited to: abnormal blood
pressure, fainting, heart attack or death. By signing, signing
up, joining you assume all risk for your health and
well-being, and fully release and hold harmless for any
responsibility, cost or damages Rebel Origin, its instructors,
members and employees. You hereby acknowledge that you, and
any minor* under your care, fully release. * No one under 15
may participate. A minor aged 15-18 may participate with a
parent present.
The content on the Rebel Origin website, including without
limitation, the text, software, scripts, graphics, photos,
sounds, music, videos, interactive features and the like
(“Content”) and the trademarks, service marks and logos
contained therein (“Marks”), are owned by or licensed to Rebel
Origin, subject to copyright and other intellectual property
rights under the law. Content on the website is provided to
you as is for your information and personal use only and may
not be downloaded, copied, reproduced, distributed,
transmitted, broadcast, displayed, sold, licensed, or
otherwise exploited for any other purposes whatsoever without
the prior written consent of the respective owners. Rebel
Origin reserves all rights not expressly granted in and to the
website and the Content. You acknowledge and agree that any
questions, comments, suggestions, ideas, feedback or other
information about the website or services, provided by you to
Rebel Origin are non-confidential and shall become the sole
property of Rebel Origin.
You agree to not engage in the use, copying, or distribution
of any of the Content other than expressly permitted herein.
You agree not to circumvent, disable or otherwise interfere
with security-related features of the website or features that
prevent or restrict use or copying of any Content or enforce
limitations on use of the website or the Content therein.
Rebel Origin trademarks and trade dress may not be used,
including as part of trademarks and/or as part of domain
names, in connection with any product or service in any manner
that is likely to cause confusion and may not be copied,
imitated, or used, in whole or in part, without the prior
written permission of Rebel Origin.
MOBILE SERVICES
The Rebel Origin Services may include certain services that
may be available via your mobile phone, including but not
limited to (i) the ability to book and/or purchase Rebel
Origin via your mobile phone, (ii) the ability to receive and
reply to Rebel Origin messages, (iii) the ability to browse
Rebel Origin from your mobile phone and (iv) the ability to
access certain Rebel Origin features through a mobile
application you have downloaded and installed on your mobile
phone (collectively the “Mobile Services”). We do not charge
for these Mobile Services. However, your carrier’s normal
messaging, data and other rates and fees will still apply. You
should check with your carrier to find out what plans are
available and how much they cost. In addition, downloading,
installing, or using certain Mobile Services may be prohibited
or restricted by your carrier, and not all Mobile Services may
work with all carriers or devices. Therefore, you should check
with your carrier to find out if the Mobile Services are
available for your mobile devices, and what restrictions, if
any, may be applicable to your use of such Mobile Services. By
using the Mobile Services, you agree that we may communicate
with you regarding Rebel Origin and other entities by SMS,
MMS, text message or other electronic means to your mobile
device and that certain information about your usage of the
Mobile Services may be communicated to us.
TERMINATION
We may terminate your access to the Site, without cause or
notice, which may result in the forfeiture and destruction of
all information associated with you. All provisions of this
Agreement that by their nature should survive termination
shall survive termination, including, without limitation,
ownership provisions, warranty disclaimers, indemnity, and
limitations of liability.
THIRD PARTY SITES
Our Site may contain links to third-party sites that are not
owned or controlled by Rebel Origin.
Rebel Origin has no control over, and assumes no
responsibility for, the content, privacy policies, or
practices of any third-party sites or services. We strongly
advise you to read the terms and conditions and privacy policy
of any third-party site that you visit.
GOVERNING LAW
This Agreement (and any further rules, polices, or guidelines
incorporated by reference) shall be governed and construed in
accordance with the laws of England without giving effect to
any principles of conflicts of law.
CHANGES TO THIS AGREEMENT
We reserve the right, at our sole discretion, to modify or
replace these Terms of Service by posting the updated terms on
the Site. Your continued use of the Site after any such
changes constitutes your acceptance of the new Terms of
Service.
We encourage you to review this Agreement periodically for
changes. If you do not agree to any of this Agreement or any
changes to this Agreement, do not use, access or continue to
access the Site or discontinue any use of the Site
immediately.
ELIGIBILITY
Membership is void where prohibited. This website is intended
solely for Users who are 13 years of age or older. Any
registration by, use of or access to the website by anyone
under 13 is unauthorized, unlicensed and in violation of these
Terms of Use. By using Rebel Origin Services or the website,
you represent and warrant that you are 13 or older and that
you agree to abide by all of the terms and conditions of these
Terms of Service. Minors between the ages of 13 and 18 may
register on our website only with the involvement of a parent
or guardian.
TERM
These Terms of Service shall remain in full force and effect
while you use the Rebel Origin Services or are a Member. You
may terminate your membership at any time, for any reason, by
following the instructions on the “My Account” page or by
contacting your local studio directly via phone or email.
Rebel Origin may terminate your membership at any time,
without warning, if you breach these Terms of Service. Even
after membership is terminated, these Terms of Service will
remain in effect.
FEES
You acknowledge that Rebel e charges fees for its services,
and Rebel Origin reserves the right to change its fees from
time to time in its discretion. If Rebel Origin terminates
your membership because you have breached these Terms of
Service, you may not be entitled to a refund of any unused
portion of membership or other fees.
PASSWORD
When you sign up for member Services, you will also be asked
to choose a password. You are entirely responsible for
maintaining the confidentiality of your password. You agree
not to use the account, username, or password of another
member at any time or to disclose your password to any third
party. You agree to notify Rebel Origin immediately if you
suspect any unauthorized use of your account or access to your
password. You are solely responsible for any and all use of
your account.
ENTIRE AGREEMENT; NO WAIVER
These Terms of Service, together with our Privacy Policy, and
any other legal notices published by Rebel Origin on the
website, shall constitute the entire agreement between you and
Rebel Origin concerning our website. If any provision of these
Terms of Service is deemed invalid by a court of competent
jurisdiction, the invalidity of such provision shall not
affect the validity of the remaining provisions of these Terms
of Service, which shall remain in full force and effect. No
waiver of any term of these Terms of Service shall be deemed a
further or continuing waiver of such term or any other term,
and Rebel Origin failure to assert any right or provision
under these Terms of Service shall not constitute a waiver of
such right or provision. Rebel Origin reserves the right to
amend these Terms of Service at any time and without notice,
and it is your responsibility to review these Terms of Service
for any changes. Your use of the Rebel Origin website
following any amendment of these Terms of Service will signify
your assent to and acceptance of its revised terms.
ARBITRATION
YOU AND REBEL ORIGIN AGREE THAT, EXCEPT AS MAY OTHERWISE BE
PROVIDED IN REGARD TO SPECIFIC SERVICES ON THE SITE IN ANY
SPECIFIC TERMS APPLICABLE TO THOSE SERVICES, THE SOLE AND
EXCLUSIVE FORUM AND REMEDY FOR ANY AND ALL DISPUTES AND CLAIMS
RELATING IN ANY WAY TO OR ARISING OUT OF THESE TERMS OF USE,
THE SITE AND/OR THE SERVICE (INCLUDING YOUR VISIT TO OR USE OF
THE SITE AND/OR THE SERVICE) SHALL BE FINAL AND BINDING
ARBITRATION, except that to the extent that either of us has
in any manner infringed upon or violated or threatened to
infringe upon or violate the other party’s patent, copyright,
trademark or trade secret rights, or you have otherwise
violated any of the User conduct rules set forth above then
the parties acknowledge that arbitration is not an adequate
remedy at law and that injunctive or other appropriate relief
may be sought.
